Agreement
By creating an account, building a memorial page, or using eternalobituary.com (the “Service”), you agree to these Terms of Use. If you do not agree, please do not use the Service.
Eligibility and your account
You must be at least 18 years old (or the age of majority where you live) to create an account. You agree to provide accurate information and to keep your login credentials secure.
You are responsible for all activity under your account, including actions taken by co-managers you invite. Notify us promptly at support@eternalobituary.com if you suspect unauthorized access.
What the Service provides
Eternal Obituary lets you create, edit, and publish online memorial pages for someone who has passed away. Features may include obituaries, photos, galleries, memory walls, timelines, service details, RSVP tools, and sharing links or QR codes.
We work to keep the Service reliable, but we do not guarantee uninterrupted or error-free operation. We may update, add, or remove features over time.
Draft, active, and public pages
Memorial pages can exist in different states. A draft page is only visible to you and people you authorize while you are building it. When you activate a page (after choosing a paid plan), it becomes publicly available at your memorial URL unless you later set it to closed.
A closed page may limit what visitors see while keeping the URL reserved. You control visibility from your dashboard.
Acceptable use
You agree not to use the Service to:
- Impersonate another person or misrepresent your relationship to the person being honored
- Post illegal, harassing, hateful, or exploitative content
- Send spam or unsolicited commercial messages through memorial features
- Upload malware or attempt to disrupt or access systems without permission
- Violate someone else's privacy, publicity, or intellectual property rights
We may suspend or remove content, or terminate accounts, if we reasonably believe these terms have been violated.
Your content
You retain ownership of the photos, text, and other materials you upload (“User Content”). By using the Service, you grant us a limited license to host, store, display, and deliver your User Content solely to operate the Service — including showing it on your memorial page and backing it up securely.
You represent that you have the rights needed to upload User Content and to allow visitors to submit content to your page. You are responsible for moderating visitor submissions when that applies to your page.
Payments and plans
Publishing a memorial page requires a paid plan. Current options include a monthly subscription, a yearly subscription, and a one-time lifetime plan. Prices and features are shown at checkout and may change for new purchases; existing subscriptions are handled according to the plan you selected.
Payments are processed by Stripe and/or PayPal. By paying, you also agree to the applicable payment provider's terms. We do not store your full payment card details on our servers.
- Monthly and yearly plans renew automatically until you cancel. Your page stays active while the subscription is current.
- Lifetime plan is a one-time payment intended to keep your memorial page online for the long term, subject to these terms and our continued operation of the Service.
Refunds and cancellations
Because activation unlocks immediate access to hosting and features, fees are generally non-refundable once a plan has been activated, except where required by law or where we choose to make an exception in a specific case.
You may cancel a recurring subscription at any time from your dashboard or by contacting support. Cancellation stops future charges; it does not automatically delete your memorial content. If a subscription lapses without renewal, your page may become inactive until you subscribe again or switch to lifetime.
Charge disputes should be directed to support@eternalobituary.com before initiating a chargeback, so we can help resolve the issue.
Account termination
You may delete a memorial page or stop using the Service at any time. We may suspend or terminate your account if you breach these terms, fail to pay for an active plan, or if we must do so to comply with law or protect the Service and other users.
Upon termination, your right to use the Service ends. We may delete associated content after a reasonable period, subject to our Privacy Policy and legal retention requirements.
Disclaimer
The Service is provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will meet every family's specific needs or that all content submitted by visitors will be accurate or appropriate.
Indemnity
You agree to indemnify and hold us harmless from claims arising out of your User Content, your use of the Service, or your violation of these terms or another person's rights.
Changes to these terms
We may update these Terms of Use from time to time. We will post the revised version on this page and update the effective date. Your continued use of the Service after changes take effect constitutes acceptance of the updated terms.
